FUNDACIÓN BRINGAS-HAGHENBECK, I.A.P. (hereinafter referred to as THE FOUNDATION), committed to the protection of your Personal Data, assumes responsibility for its use, management, storage, and confidentiality in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter referred to as THE LAW) and, in order to inform you about the main characteristics of the processing to which your Personal Data will be subjected, issues the following:

COMPREHENSIVE PRIVACY NOTICE

In compliance with THE LAW, we hereby inform you of the following:

I. Data Controller.

THE FOUNDATION is responsible for the processing of your personal data in accordance with Article 3, Section XIV of THE LAW.

II. Data Controller's Address.

THE FOUNDATION is located at Calzada de Tlalpan No. 4835, Colonia Tlalpan, Alcaldía Tlalpan, C.P. 14000, Mexico City.

III. Principles.

Your Personal Data will be processed based on the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality, and responsibility, in accordance with the legislation. The confidentiality of your personal data will be maintained through effective administrative, technical, and physical security measures to prevent damage, loss, alteration, destruction, unauthorized use, access, or disclosure.

IV. Personal Data Collected and Subject to Processing by THE FOUNDATION.

THE FOUNDATION, through its main offices and its educational and assistance centers, namely:
i) Colegio Luz Bringas Preschool,
ii) Colegio Luz Bringas Primary School,
iii) Colegio Luz Bringas Secondary School,
iv) Colegio Agustín García Conde Primary School,
v) Colegio Agustín García Conde Secondary School,
vi) Emil Adolf Von Behring Nursing School,
vii) San Lorenzo Community Center,
viii) Social Assistance Center,
ix) Las Magnolias Residence,
x) San Francisco Residence,
xi) Teodoro Gildred Residence,
xii) Mateos Portillo Residence,

may request the following general personal data: name, address, phone number, email address, age, gender, place and date of birth, Tax Status Certificate, Unique Population Registry Code (CURP), academic and employment data, and for minors: their name, address, and age.

Additionally, as a result of the legal relationship that may be established between THE FOUNDATION, its educational and/or assistance centers, and you or your family members, financial and patrimonial data may be required, in accordance with Article 8 of THE LAW. Sensitive data may also be requested, as defined in Article 3, Section VI of THE LAW, including:
a) Biometric data,
b) Health data,
c) Data regarding individuals with disabilities,
d) Religious beliefs.

In compliance with Article 9 of THE LAW, you are informed that your express consent is required to collect and process sensitive data. Therefore, when this information is requested, you will be asked to indicate whether you accept the processing of such data.

It is the responsibility of the Data Subject to ensure that the information provided to THE FOUNDATION is true and complete, and to notify THE FOUNDATION of any changes in order to fulfill the obligation to maintain accurate and up-to-date records.

V. Safeguarding of Personal Data.

The information provided to THE FOUNDATION will be properly safeguarded, preserved, and protected with the appropriate technological and physical means to prevent loss, misuse, alteration, unauthorized access, or theft. Access to the information will be restricted to those persons expressly authorized, either employees or service providers, who are committed to maintaining strict confidentiality and security.

In the event that the personal data safeguarded is required by any authority, whether for legal proceedings, to respond to claims, or to protect the rights of THE FOUNDATION, such data will be made available in strict compliance with the Law.

VI. Purpose of Data Processing and Personal Data Collected.

In accordance with Article 16 of THE LAW and Articles 26, 27, and 28 of its Regulations, you are informed that the aforementioned personal data will be used by THE FOUNDATION, through its main offices and educational and assistance centers, for the following purposes:

Main Offices

  1. Contracting services.

  2. Entering into lease agreements.

  3. Receiving and/or delivering donations.

  4. Recruitment and hiring of personnel, including volunteers, social service providers, and professional service providers.

  5. Signing inter-institutional agreements.

Educational Centers

  1. Providing basic educational services (preschool, primary, and secondary) and high school services for you and/or your children at any of our educational centers:

    • Colegio Luz Bringas Preschool,

    • Colegio Luz Bringas Primary School,

    • Colegio Luz Bringas Secondary School,

    • Colegio Agustín García Conde Primary School,

    • Colegio Agustín García Conde Secondary School,

    • Emil Adolf Von Behring Nursing School,

in accordance with our social purpose.

  1. Offering information and scholarships available through THE FOUNDATION.

Assistance Centers

  1. Providing community development assistance services required by you and/or your family members at any of THE FOUNDATION’s assistance centers:

    • San Lorenzo Community Center,

    • Chalco Center,

in accordance with our social purpose.

  1. Providing assistance services such as shelter, food, clothing, occupational activities, and medical care to elderly persons at any of THE FOUNDATION’s residences:

    • Las Magnolias Residence,

    • San Francisco Residence,

    • Teodoro Gildred Residence,

    • Mateos Portillo Residence,

in accordance with our social purpose.

Additionally, to facilitate communication between THE FOUNDATION’s centers, federal and local authorities, health, tax, and labor authorities, and your relatives or legal guardians, for example, in case of an emergency.

We commit not to transfer your personal information to third parties without your consent, except as provided under Article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties.

VII. Acceptance or Objection to Transfers or Refusal to Data Processing.

If you do not express your objection to the processing and, where appropriate, the transfer of your personal data, it will be understood that you have given your consent, and this consent will be valid for all purposes arising from the contractual relationship.

VIII. Procedure for Handling Requests for Revocation and Rights of Access, Rectification, Cancellation, and Opposition (ARCO).

According to THE LAW, you may request access, rectification, cancellation (if legally appropriate), or opposition to the use of the personal data you have provided to THE FOUNDATION, or revoke the consent granted, within 5 business days after giving your consent to this Privacy Notice.

Requests should be made via email to contacto@fbh.org.mx and will be handled by Miss Andrea Martínez Martínez. Your request must include:

  1. Your full name and the email address to which you would like the response sent.

  2. A clear, precise, and specific description of the personal data for which you seek to exercise any of the mentioned rights, along with any documents or information that facilitate the location of the data.

  3. A legible copy of an official valid ID of the data subject. If the procedure is carried out by a legal representative, a power of attorney or equivalent document signed before two witnesses, along with a copy of the representative’s ID, must be attached.

  4. In the case of a Rectification request, documentation supporting the changes must be provided.

Upon receipt of your request, THE FOUNDATION may request additional information or documentation within 5 business days. You will have 10 business days to respond; otherwise, your request will be deemed not submitted.

THE FOUNDATION will issue a resolution within 20 business days and will notify you through the means indicated in your request. If the resolution is favorable (in whole or in part), it will be implemented within 15 business days thereafter.

These deadlines may be extended once if necessary, and you will be notified accordingly.

IX. Options to Limit the Use or Disclosure of Your Personal Data.

Pursuant to Article 16, Section III of THE LAW, you may limit the use or disclosure of your personal data by sending an email to contacto@fbh.org.mx, which will be handled by Miss Andrea Martínez Martínez.

IX. Complaints and Reports for Improper Treatment of Your Personal Data.

If you believe that your right to personal data protection has been violated, or if you suspect that any violation of THE LAW has occurred, you may file a complaint with the National Institute for Transparency, Access to Information, and Protection of Personal Data (INAI).

X. Changes to the Privacy Notice.
